CUSTOMER ADVISORY NOTICE: 2026-02:  Ending Collection of International Emergency Economic Powers Act Duties.

In a landmark decision on the scope of presidential authority, the Supreme Court on February 20, 2026, invalidated the broad tariffs imposed by President Donald Trump through a series of executive orders. In a 6–3 ruling, the Court held that the tariffs exceeded the authority delegated by Congress under the 1977 law granting the president power to regulate commerce during national emergencies arising from foreign threats.

Following the decision, U.S. Customs and Border Protection (CBP) issued Cargo Systems Messaging Service (CSMS) Notice #67834313, which effectively rescinded all Executive Orders that had been implemented under the International Emergency Economic Powers Act (IEEPA).

Several additional significant CSMS notices were released following the Supreme Court’s decision. The first implemented temporary Section 122 duties pursuant to the February 20, 2026 Presidential Proclamation, “Imposing a Temporary Import Surcharge to Address Fundamental International Payment Problems.” Under this Proclamation, an additional 10% ad valorem duty was applied to imports from all countries for 150 days, unless a specific exemption applied.

The second significant CSMS notice extends the suspension of duty-free de minimis treatment to all countries, expressly including shipments sent through international postal systems.

Notably, the various messages did not address the potential for refunds of duties and tariffs previously paid under IEEPA.
